Resectaur — Terms of Service

Thank you for visiting Resectaur.com, an educational platform for medical professionals to collect, share, and interactively discuss radiology cases, participate in channels and communities, attend live conferences, earn CME/CPD credits, and access curated learning pathways — from any device.
Acceptance of Terms
The following are terms of a legal agreement between you ("User") and Sectaur Collaborative Limited (NZBN: 9429048822091) ("Resectaur", "we", "our" or "us"). These Terms of Service govern your use of the website located at https://www.resectaur.org/ ("Site") and any related services provided by Resectaur, including Resectaur's web application ("App"). The Site, App, and all related services are collectively referred to as the "Platform".
By accessing the Platform, you agree to abide by these Terms of Service, our Privacy Policy (available at https://www.resectaur.org/company/privacy), and all applicable laws and regulations. If you do not agree with these Terms of Service or our Privacy Policy, you are prohibited from using or accessing the Platform and must cease use immediately.
Please take the time to read these Terms of Service carefully as they contain important information regarding your legal rights, remedies, and obligations, including various limitations and exclusions and an important Medical Disclaimer.
Description of Service
The Resectaur Platform provides the following core services to registered medical professionals:
• Storage: Collect and save anonymised medical imaging cases on secure cloud storage for educational purposes. • Presentation: Use the Platform to present cases at conferences, meetings, or educational events. • Sharing: Securely share cases with other registered Platform Users for educational purposes. • Channels: Community spaces where members can share cases, discuss topics, and access curated educational content. • Interactive Content: Educational assets including video tutorials, slide presentations, quizzes, TI-RADS calculators, and structured case studies. • Conferences: Live video conferencing with screen sharing, recording, and audience participation tools, hosted through the Platform. • Learning Pathways: Curated routes through educational content with progress tracking and optional CME/CPD credit allocation. • CME/CPD Tracking: Continuing medical education credit tracking and certificate generation for completed learning activities. • QR Code Sharing: Generate QR codes to share cases and content outside the Platform.
If you wish to add, curate, or edit content on the Platform, subscribe to services, have a profile page, or be entitled to notification of material changes to these Terms of Service, you must register on the Site and create an account. Any such account may be terminated in accordance with these Terms of Service.
User Roles and Responsibilities
The Platform provides different levels of access and capability based on your role. By registering, you are assigned a role that determines the features available to you.
Platform-Level Roles:
• User: Create a limited number of cases, access public content, join channels, post cases to channels, and share cases via public links. • Educator: All User capabilities, plus create unlimited cases and case collections, and create slide presentations associated with cases or collections within channels. • Creator: All Educator capabilities, plus full content creation across all interactive content types (videos, slides, quizzes, TI-RADS, conferences), create and manage channels, monetize content, and curate Learning Pathways.
Channel-Level Roles:
• Owner: The Creator who established the channel. Manages channel settings, approves members, sets monetization, and hosts conferences. • Moderator: Assists with channel management including approving join requests, managing conferences, and moderating community content. • Member: Participates in the channel by posting cases, engaging in discussions, and accessing channel content based on permissions set by the Owner.
Role upgrades may be available through subscription plans or by arrangement with Resectaur. You agree to use your assigned role's capabilities in accordance with these Terms and applicable professional standards.
Medical Disclaimer
The Resectaur Platform is intended for general educational purposes only and contains no representations or warranties as to the accuracy, reliability, or completeness of the information provided.
All materials — including cases, videos, slide presentations, quizzes, TI-RADS calculators, conference recordings, learning pathway content, polls, and any other user-generated or platform-provided content — are presented "as is" and "as available", and may contain unintended or unrecognised errors or omissions.
Discussions, recommendations, and educational content expressed on the Platform should not be considered absolute or universal for every clinical situation. Resectaur assumes no legal liability or responsibility for the accuracy, currency, or completeness of any such material.
The Platform is intended for use by medical professionals and is not intended to be, and should not serve as, a substitute for professional medical care. No medical opinions should be provided to patients based on any content on the Platform.
CME/CPD certificates generated through the Platform reflect completion of educational activities and do not constitute clinical endorsement or professional accreditation beyond the scope stated on each certificate.
Confidentiality and Privacy
We respect your privacy and understand that protecting your personal information and that of your patients is very important.
Our Privacy Policy, available at https://www.resectaur.org/company/privacy, sets out how we collect, hold, use, disclose, and protect your personal information. By using the Platform, you acknowledge and agree to the collection and use of information as described in our Privacy Policy.
You are required to accept both these Terms of Service and our Privacy Policy to use the Platform. Acceptance of updated versions of either document may be required from time to time.
Ownership and Licenses
6a — Your license to use our Platform
Provided that you accept and adhere to these Terms of Service, you are granted a non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. All other uses are prohibited without our prior written consent.
6b — The Service
We offer our Platform and its associated services to licensed medical professionals or medical professionals-in-training who have been given access through an agreement between us and the employer/institution of the User, or the User themselves in their capacity as an independent licensed healthcare professional (including but not limited to radiologists and pathologists). Any use outside of the above, including use for commercial purposes not facilitated through the Platform's built-in monetization features, requires the User to enter into a separate written agreement with us.
6c — Ownership of user-generated content
Ownership of all data, including Image Content, Video Content, and Text Content ("Your Content") that you contribute to our Platform as a User belongs to you, or the third party holding the intellectual property rights. By using our Platform to upload, store, share, or transmit content, you grant us, as permitted under applicable law, a non-exclusive, royalty-free, transferable, worldwide license to use, store, distribute, modify, run, copy, publicly display, translate, or create derivative works of your content. This includes the development of educational courses or materials that may be monetised by us.
You warrant that you have all necessary rights to the data and to grant us this license. The license extends beyond the deletion of your content or account for a period necessary to maintain the integrity of the courses developed, though it can be terminated in other respects as per your privacy preferences and our Privacy Policy. We commit to using your content in a manner that upholds professional and ethical standards in the field of radiology and medical education.
6d — Monetization
Creators may set access levels and pricing for their content, channels, and learning pathways through the Platform's built-in monetization features. Revenue sharing terms between Creators and Resectaur are governed by the Creator agreement established at the time of Creator role activation. Resectaur reserves the right to modify revenue sharing terms with 30 days' notice.
6e — Displaying material in training sessions and conferences
Displaying material during a conference, symposium, or training session — whether in person or via the Platform's video conferencing feature — may only be done if the patient whose case is being discussed cannot be identified, or if the patient has given their consent. You must ensure that any case information pertaining to a patient is not disclosed in a manner that would enable identification of the patient.
Account Verification and User Eligibility
7a — Professional Eligibility
To create and maintain an account on the Resectaur Platform, you must be a licensed medical professional or medical professional-in-training. During registration, you must provide accurate and complete information including your full name, contact details, professional qualifications, current workplace or institution, and specialty or primary area of interest.
7b — Verification
Resectaur reserves the right to verify the authenticity of user accounts at any time. This verification may include validation of professional credentials, confirmation of institutional affiliation, or requests for additional documentation to confirm professional status.
7c — Account Suspension
We reserve the right to suspend or terminate accounts that provide false or misleading information, cannot be verified as legitimate medical professionals, or violate any terms of this agreement. If your account is suspended, you will be notified via email with instructions on how to resolve the issue.
Intellectual Property Rights
All intellectual property rights in the Platform — including its design, code, video content hosted via third-party providers, slide presentations, quiz engines, and all other proprietary components — are owned or licensed to Resectaur and are protected by applicable copyright and trademark law.
You may not copy or download extracts of any aspect of the Platform or services provided unless there is a feature in the Platform expressly permitting such copying or downloading. If you have downloaded or made copies in accordance with these Terms of Service, you are not entitled to modify the downloaded or copied material and may not separate any illustrations, photographs, video or audio sequences from text accompanying such media.
The author of the material shall, to the extent required under applicable law, be recognised. Nothing in these Terms of Service shall be construed as a transfer of any intellectual property right or any other right to you. You are only given the limited license as described above. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Resectaur at any time.
User Conduct
9a — Limitations of use
When you use our Platform, we expect you to abide by a certain standard of professional behavior. You must not do or attempt to do anything that is unlawful, prohibited by applicable laws or regulations, or which we would consider inappropriate. By using this Platform, you warrant that you will not:
• Modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on the Platform. • Remove any copyright or other proprietary notations from any materials and software on the Platform. • Transfer the materials to another person or "mirror" the materials on any other server. • Knowingly or negligently use the Platform in a way that abuses or disrupts our networks or any other service Resectaur provides. • Use the Platform to transmit or publish any harassing, indecent, obscene, hateful, fraudulent, or unlawful material. • Use the Platform in conjunction with sending unauthorised advertising or spam. • Harvest, collect, or gather user data without the user's consent. • Use the Platform in violation of any applicable laws or regulations. • Post misleading, defamatory, or inappropriate content in channels, feeds, or direct messages. • Disrupt conferences or live sessions through abusive behavior. • Misrepresent professional credentials or qualifications. • Use content flagging or reporting features in a vexatious manner. • Attempt to circumvent access controls or payment requirements.
9b — Notice of inappropriate use
If you encounter any material that you believe infringes these Terms of Service, receive abusive or inappropriate messages from other Users, or have any reason to believe the Platform is being used for illegal purposes or purposes not in accordance with these Terms, please contact us at info@resectaur.org.
Payment Terms and Billing
10a — Payment Processing
All payments for premium features, subscriptions, channel access, or other paid services on the Resectaur Platform are processed through Stripe, our secure third-party payment service provider. By making a purchase, you agree to provide current, complete, and accurate purchase and account information. Resectaur does not store or have access to your complete payment card details, which are handled securely by Stripe in compliance with PCI DSS standards.
10b — Accepted Payment Methods
We accept major credit cards, debit cards, and other payment methods as displayed during the checkout process. The availability of specific payment methods may vary depending on your location.
10c — Pricing and Currency
All prices are displayed in the currency selected during checkout. Prices include applicable taxes (such as VAT or GST) where required by law, calculated and collected automatically based on your location. The final price, including all applicable taxes, will be clearly displayed before you complete your purchase.
10d — Platform and Channel Products
The Platform offers two categories of paid products: platform-level subscriptions (which determine your role and capabilities) and channel-level products (which grant access to specific channel content, set by the channel Owner). Each has its own pricing, billing cycle, and terms as displayed at the time of purchase.
10e — Failed Payments
If a payment fails, we will attempt to notify you via email. For subscription services, we may retry the payment according to our dunning procedures. If payment cannot be processed after reasonable attempts, your access to paid features may be suspended or terminated. You remain responsible for any outstanding amounts owed.
Subscription Terms
11a — Subscription Services
Certain features and content on the Resectaur Platform may be offered on a subscription basis, including platform-level role upgrades and individual channel access. Subscriptions may be offered on monthly, annual, or other billing cycles as specified at the time of purchase.
11b — Auto-Renewal
IMPORTANT: Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew for successive periods of the same duration as the original subscription term. You will be charged the then-current subscription rate, which may differ from the rate you initially paid. You authorise us (or our payment service provider) to charge your payment method for the renewal subscription fee.
11c — Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at info@resectaur.org. Cancellation will take effect at the end of your current billing period. You will continue to have access to subscription features until the end of the period you have paid for. We do not provide refunds or credits for partial subscription periods, except as required by law or as specified in our Refund Policy.
11d — Price Changes
We reserve the right to change subscription prices at any time. If we increase the price of your subscription, we will notify you at least 30 days before the change takes effect. The new price will apply to your next billing cycle after the notice period. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.
11e — Access After Cancellation
Upon cancellation or expiration of your subscription, you will lose access to premium features and content. However, any content you created and uploaded to the Platform (such as cases, presentations, or educational materials) will remain accessible to you in accordance with the access level available to your downgraded role.
Refund Policy
12a — Refund Eligibility
We offer a 14-day money-back guarantee for first-time purchases of subscription services. If you are not satisfied with your subscription within 14 days of your initial purchase, you may request a full refund. This guarantee applies only to your first subscription purchase and does not apply to renewal charges.
12b — Refund Conditions
Refunds may be granted in the following circumstances: • Technical issues that prevent you from accessing the Platform, provided we are unable to resolve the issue within a reasonable timeframe. • Duplicate charges or billing errors. • Unauthorised charges (subject to verification). • Other circumstances at Resectaur's sole discretion.
12c — Non-Refundable Items
The following are generally not eligible for refunds: • Subscription renewals after the initial 14-day period. • One-time purchases of individual courses, channel access, or content after access has been granted. • Services that have been substantially used or consumed. • Refund requests made more than 14 days after the purchase date (except for billing errors).
12d — Refund Process
To request a refund, please contact us at info@resectaur.org with your account details and reason for the refund request. We will review your request and respond within 5 business days. If approved, refunds will be processed to your original payment method within 10 business days. Please note that it may take additional time for the refund to appear in your account depending on your payment provider.
12e — Refunds and Access
If a refund is granted, your access to the paid features or content will be revoked immediately. Any content you created will remain accessible in accordance with your base role's access levels.
Third-Party Services
The Platform relies on third-party service providers to deliver certain functionality. By using the Platform, you acknowledge that your data may be processed by these services in accordance with their respective terms and privacy policies:
• Microsoft Azure: Cloud hosting, data storage (CosmosDB), blob storage for media files, and Azure B2C for authentication. • Stripe: Payment processing for subscriptions and one-time purchases. • Mux: Video streaming, storage, and playback for educational video content. • Daily.co: Live video conferencing infrastructure for Platform-hosted conferences. • PostHog: Product analytics (with user opt-out available). • Postmark: Transactional email delivery.
Resectaur has not reviewed all third-party sites or content linked to its Platform and is not responsible for the contents of any such linked sites or third-party content. The inclusion of links does not imply endorsement, approval, or control by Resectaur. Use of any linked site or content is at your own risk.
Warranties, Liability, and Indemnification
14a — User-generated content warranties
In respect of all content that you contribute on the Platform, you warrant that you have the right to contribute such content and to allow such content to be used in accordance with these Terms of Service. You further warrant that such content: has been collected by you in a diligent and professional manner and in accordance with our Privacy Policy; is de-identified such that the identity of each patient to whom your content relates is not identifiable or reasonably identifiable; comprises legitimate and original content that has not been copied from any secondary source; and will not infringe any third-party intellectual property rights when used on, or in connection with, the Platform.
You further warrant that any recommendations for patient care or diagnosis in your content are based on current science, evidence, and clinical reasoning; are supported by appropriate reference material; identify any new or evolving practices with limited evidence; do not advocate practices unsupported by clinical evidence; and are free from real or perceived commercial bias.
14b — Limitation of Liability
Our Platform and materials are provided on an "as is" basis. We are not responsible for any incorrect or incomplete information provided within or in connection with the Platform, including user-generated content. We strongly advise all Users to exercise caution in the interpretation and implementation of information obtained through the Platform. Your use of the Service is solely your responsibility and at your own risk.
To the maximum extent permitted by law, Resectaur and its associates assume no responsibility for, and make no warranty or representation: as to the accuracy, currency, completeness, reliability or usefulness of any information obtained through use of any Platform; that confidentiality of information transmitted through the Platform will be maintained; or that any access to or use of the Platform will be uninterrupted, error-free, or free of defects, viruses, or other harmful components.
In no event shall Resectaur or its associates be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use the Platform, even if Resectaur has been notified of the possibility of such damage. "Consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use, and/or loss or corruption of data.
14c — New Zealand Users — Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any rights which you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 which cannot be excluded, restricted, or modified.
Termination
We may suspend or terminate your right to use the Platform and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
You may terminate your account at any time by contacting Resectaur at info@resectaur.org. Upon termination, your right to access the Platform will cease. Content you created will be handled as follows: cases and content you own will be retained for a reasonable period to allow you to export them, after which they may be deleted; content incorporated into educational materials by Resectaur or other Creators (under the license granted in Section 6c) may continue to be used.
If you have active subscriptions at the time of termination, you will not receive a refund for any remaining subscription period unless required by law.
Changes to Terms
We may, at any time and at our discretion, vary these Terms by publishing the varied terms on our Site. Each version will be identified by a version number and effective date.
Where required by law, and provided you have registered with the Site, we will inform you of material changes before they enter into force. We will provide such information by email to the address provided during registration. When we publish updated Terms, you will be asked to review and accept the new version before continuing to use the Platform.
Resectaur may also make improvements or changes in the products, services, or programs described on the Platform at any time without notice.
Severability
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
Governing Law
These Terms of Service and your use of our Site and Platform are governed by the laws of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New Zealand.
Our Platform may be accessed throughout New Zealand and overseas. We make no representation that our Platform complies with the laws (including intellectual property laws) of any country outside New Zealand. If you access our Platform from outside New Zealand, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Platform.
In the absence of mutual agreement, any dispute arising from the interpretation and/or performance of these Terms of Service shall be submitted to the exclusive jurisdiction of the competent Courts of New Zealand.
Dispute Resolution
If you would like to give us feedback, please contact us — we appreciate your input. In the event of any dispute arising from, or in connection with, these Terms ("Dispute"), Users may bring any disputes to Resectaur who will try to resolve them amicably.
While your right to take legal action shall always remain unaffected, in the event of any controversy regarding the use of the Platform or the Service, you are kindly asked to contact Resectaur at the contact details provided in this document. You may submit a complaint including a brief description and, if applicable, the details of the related order, purchase, or account.
Resectaur will process the complaint without undue delay and within 21 days of receiving it.
Cookies
The Platform uses cookies to provide essential functionality including authentication and session management. We also use analytics cookies (via PostHog) to understand how the Platform is used and to improve our services.
